Terms and conditions

Clients must register to use the ICE Recruit for recruiters service.

The Client is responsible for the content of the vacancy and will indemnify Thomas Telford Ltd ('TTL', Company No. 02556636) against any claim, loss, liability, expense and/or damage in connection therewith.

TTL does not guarantee that the Client will receive any responses to its displayed job vacancies.

Applicants' responses will be forwarded by TTL by E-mail subject to any filtering and ranking. The Client is responsible for verifying the information contained in Applicants' responses and TTL accepts no responsibility for the content of any such application.

It is the Client's responsibility to protect their computers against any viruses.

All and any subsequent dealings between the Client and any Applicant and in connection with the Applicant's response to the vacancy are the responsibility of the Client and TTL accepts no liability whatsoever therewith. The Client will indemnify TTL against any claim, loss, liability, expense and/or damage in connection therewith.

The Client will comply with the provisions of the Data Protection Act 1998 and General Data Protection Act in relation to all Applicants' details and indemnify TTL against any claim, loss, liability, expense and/or damage in connection therewith.

The Client will comply with all anti-discrimination legislation including but not limited to the Sex Discrimination Act 1975, the Race Relations Act 1976 and the Disability Discrimination Act 1995. The client will indemnify TTL against any claim, loss, liability, expense and/or damage in connection therewith.

The Client, if an Employment agency or an Employment business, will comply with the provisions of the Employment Agencies Act 1973 in relation to all vacancies posted on our site, communications with Applicants and management of Applicants' details and indemnify TTL against any claim, loss, liability, expense and/or damage in connection therewith. TTL monitors the quality of vacancies from time to time in order to provide a better service to candidates.

A job posted on ICE Recruit will remain live for 30 days or less if previously agreed with the customer. Any jobs posted where a contract has not been signed, will be charged at the standard rate of £595 per job. Any jobs posted in addition to the agreed number of jobs per month will be charged at a price per job agreed with the customer at the time of the contract negotiation. If no price has been negotiated, a flat fee of £595 per job will be charged for each job over the agreed number.

The Client will be given access to a search engine to search for candidate CVs which match the criteria and filtering set by the Client. Various bundles of CV downloads may be purchased, subject to a fair usage cap.

Any Services not used during the agreed contractual period will not be carried over to another period without prior consent. The Customer will be responsible for payment for any unused Services.

The Customer may terminate an agreed contract as specified on the signed order form by provision of no less than 30 days notice to expire at the end of a Contract Month.

Payment of invoices is due within 28 days of the invoice date.

TTL reserves the right in its sole and absolute discretion to remove any vacancy at any time without reason. Examples of vacancies that may be removed include, but are not limited to:

those that TTL considers illegal, inappropriate or fraudulent those that directly or indirectly require or ask for application or registration fees those that advertise franchise, pyramid, network marketing or get-rich-quick schemes those that have been indiscriminately posted or duplicated across multiple sectors those that advertise websites, services, businesses, business opportunities and/or contact details TTL reserves the right in its sole and absolute discretion to close any account at any time without reason. Examples of accounts that may be closed include, but are not limited to:

those that have not provided full or accurate contact or company information those that TTL considers to be acting inappropriately or illegally those that use ICE Recruit to advertise websites, services, businesses and/or business opportunities in any part of the job vacancy or on any part of the site By accessing or using any part, service or feature of this site, you agree to use it in good faith, i.e. to post authentic, impartial and unique jobs of reasonable quality, which provide both adequate and accurate job details. You also agree that any abuse of the service, web site or our terms and conditions can result in your own, as well as your company's access to this service being removed, and accounts terminated.

From time to time TTL will contact registered employers and agencies in order to evaluate the service they receive.

TTL reserves the right to change any aspect of the ICE Recruit for recruiter service without notice.

These terms and conditions shall be governed by and construed in accordance with the laws of England; any dispute arising out of or in connection with this Licence will be subject to and within the jurisdiction of the courts of England.

UNDER NO CIRCUMSTANCES SHALL ICE RECRUIT BE LIABLE TO THE PURCHASER OR ANY OTHER PERSON FOR ANY SPECIAL, EXEMPLARY, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER ARISING OUT OF USING THE SERVICE.  LOSSES, OR DAMAGES ARISING OUT OF ANY BREACH OF THESE TERMS AND CONDITIONS SHALL IN NO CIRCUMSTANCES EXCEED THE FEE PAID BY PURCHASER TO ICE RECRUIT UNDER THESE TERMS AND CONDITIONS THE FOREGOING LIMITATION OF LIABILITY AND EXCLUSION OF CERTAIN DAMAGES SHALL APPLY REGARDLESS OF THE SUCCESS OR EFFECTIVENESS OF OTHER REMEDIES. 

ICE Recruit will use commercially reasonable efforts to make the agreed service available to the Purchaser.  ICE Recruit will not be liable for any delay, downtime, access time error, transmission error, software or equipment incompatibilities, force majeure or other failure of performance.  In the event of any failure to deliver the agreed service, ICE Recruit's sole liability shall be to deliver such agreed service at another time.
